These Terms & Conditions (the “Terms”) govern your access to and use of the services provided by Truffle Grove (“Truffle Grove,” “we,” “us,” or “our”), including the website at trufflegrove.com (the “Site”) and our private correspondence and notification services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Truffle Grove provides private correspondence, coordination, and notification services to a limited number of invited users. Access to the Service is by invitation only. We may accept or decline any request for access, and may modify, suspend, or discontinue any part of the Service at any time, at our sole discretion.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that any information you provide to us is accurate.

3. SMS/Text Messaging Terms

The Service may send SMS/text messages — such as notifications, updates, and service-related correspondence — to individuals who have expressly consented to receive them.

• Consent. You will only receive SMS messages from the Service if you have provided your mobile phone number and expressly agreed to receive them. Consent to receive messages is not a condition of any purchase.
• Message frequency varies depending on your use of the Service.
• Message and data rates may apply. Check with your mobile carrier for details about your plan.
• Opting out. You can cancel SMS messages at any time by replying STOP. After you send STOP, we will send a final message confirming that you have been unsubscribed, and you will receive no further SMS messages unless you re-enroll.
• Help. Reply HELP to any message, or contact us at contact@trufflegrove.com, for assistance.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Our handling of mobile information is described in our Privacy Policy. Mobile information and text messaging opt-in data are never shared with third parties or affiliates for marketing or promotional purposes.

4. Acceptable Use

You agree not to use the Service to violate any applicable law or regulation; to send unlawful, deceptive, harassing, or abusive communications; to infringe the rights of any third party; to interfere with or disrupt the Service; or to attempt to gain unauthorized access to the Service or its related systems.

5. Intellectual Property

The Site and the Service, including their content, design, and branding, are owned by Truffle Grove or its licensors and are protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site or the Service without our prior written consent.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY MESSAGE WILL BE DELIVERED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUFFLE GROVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

9. Indemnification

You agree to indemnify and hold harmless Truffle Grove from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections of these Terms that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which the Service’s operator resides, without regard to conflict-of-laws principles.

12. Changes to These Terms

We may revise these Terms from time to time. The effective date above reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
